We at Appgrade Inc., (“we” or “us”) have developed our products and services with your privacy in mind.   This Privacy Policy explains how we collect, use, protect, disclose, and share information through Appgrade Inc.´s products and services (including our websites, online services, and mobile applications) such as Rebien (www.rebien.app), and how we refer to these as our “Services” or “App”.

It covers your personal information that is provided or collected through the use of our Services and how we use that information in connection with our Services.

By using our Services, you agree to this Privacy Policy. If you do not agree with any term in this Privacy Policy, please do not use our Services.

SERVICES OVERVIEW

Our App is a shared management tool for owners and co-owners to manage their physical assets (referred to as “assets”) through the web and mobile application.  The Service enables users to provide registration of their assets, a booking calendar for use, renting or maintenance of the assets, expense and income reporting, image lists, group chat, repair/maintenance request of those assets, as well as having access to a marketplace for registrants of our Services.  Owners and co-owners who are invited to join an asset group, can view that particular asset registration information, and interact among the asset group members within the calendar, expenses, image lists, chat, and repair/maintenance requests, as well as participate in any activity related to buying, selling, renting, bidding in the asset marketplace of our App´s community. Asset value, asset expenses, asset location, asset owners and their personal information registered in our App, is not public information.

Service Providers join our Service to fulfil service requests directly from registered App owners/co-owners, and solve their particular asset repair/maintenance issues.  Service Providers may request information to contact owners/co-owners registered in our App, for providing a repair/maintenance service, information such as their phone number, address of the asset, and type of asset, among other possible related information to fulfil the service request.

In order to use our App, we ask that you create an account. When you sign up, we'll ask for some registration information such as name, email address and mobile phone number. We need this information to create an account so that we can contact you about your account, so that your co-owners can join an asset group through an invitation code, and so you can access your account from anywhere.

In addition to sharing your registration information to set up your account, we collect some other information about you, such as the type of device you use and your IP address. We may also collect information about the asset you registered, or the asset groups you create. We use this information to help improve and secure our Services and to show ads or promotions based on your usage of our Services.  We don’t share your registration, personal or your asset information for marketing purposes.

Appgrade Inc. or its partners or service providers may maintain operations in the United States or any other country, and therefore your personal information may be processed outside the country where you are located. By using and providing information to us, you agree and consent to the transfer, storage, and processing of your information in other countries, including for example outside the European Economic Area. Countries that we transfer your information to may not have data protection laws similar to those of where you are located.

Our App is not intended for use by children under 13 years of age or minors. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that their child has provided us with Personal Information without their consent, they should contact us immediately at support.rebien@appgradeinc.com for the Personal Information to be deleted from our files in the next 48 hours upon notification of the event.

INFORMATION WE COLLECT

When you use our App, we may collect the following information about you:

Information you provide to us:

  • Registration information: When you sign up for an account with our service, you will be asked for registration information, such as your name, email address, mobile phone number, and a password. We require you to provide an email address in order to use our App so that we can contact you about your account, and so that you can access your data from any device. Co-owners will be able to add you to an asset group using your email address or mobile phone number. We require you to provide a name for your asset account; this is the name your co-owners will see when interacting in the asset group with you. Providing a phone number gives your co-owners another way to invite you via SMS and adds an extra layer of security to your account. You can make changes to this information at any point by emailing us at support.rebien@appgradeinc.com .
  • User-generated content: We also collect and store the information you provide to us, including when you sign up for an account, create or share, and message or communicate with others. We collect contact, calendar, income and expenses, images, lists and asset information you provide, in addition to any other information that you attach or share while using our App, including service requests sent to Service Providers. You may share this information with contacts you specify in the course of using the Service. For example, if you add an expense with a group of co-owners, those co-owners will be able to see that bill, while users who are not in the co-owners group will not. You are solely responsible for which contacts you share this information with. 
  • The way you use our service: We collect information about how you use and interact with our App. Such as the features you use, the type of information entered, the actions you take, and the time, frequency and duration of your activities. We may use that information to improve our service or suggest new features we offer.
  • Information Shared By Others: Other App users may share information with you using your contact information (such as email or mobile phone number), and that information will be stored in the course of using our App.
  • Device and Location information: When you download or use our App, we may receive information about your device and location, which allows us to provide increased account security and regulatory compliance, including device and asset location, including specific geographic locations, such as through GPS, Bluetooth, or WiFi signals.  It also allows us to provide location-based services such as targeted advertising, search results, and other personalized content.   We also collect information about your interaction with our App including, but not limited to, your computer browser type, pages visited, advertisements clicked on, average time spent on our Sites, your IP address, unique identifiers of your device, the operating system version and app version.
  • Payment information: Our App offers paid services using third-party payment processors for all payment transactions. In order to make payments for our Services, you must sign up for a payment account with Appgrade Inc.´s third-party payment processor. If you choose to subscribe to our Service, third-party payment processors will ask for additional information such as your credit or debit card number, other card information, and other account and authentication information, as well as billing, and contact details. For security purposes, you may also be asked to provide identification information to confirm your identity, including your first and last name, address, and phone number.
  • Information Related to Third Party Integrations: Our App may collect information about you from third parties to help improve our service, or for security and support reasons. If you choose to use some of the optional integrations the third-party services that we offer, we may collect information about you from those services.
  • Contests and surveys: From time to time, you may be offered an opportunity to participate in a contest, survey, or other voluntary promotion. We may collect contact or marketing information in connection with one of these promotions.  When we run a contest, sweepstake or game relating to our Services, it will be accompanied by a set of rules. The rules for each contest, sweepstakes or game will specify how the information gathered from you for entry will be used and disclosed, if it is different than as described in this Privacy Policy. In conjunction with your entry in such contest or sweepstakes, your information will be collected if you voluntarily submit it.
  • Information from other sources: We may use publicly available information about your name, email address, phone number, or other demographic data to help you during support, to address fraud or security concerns, or to personalize your experience, including by providing ads or offers. We may also collect information about you that we may receive from other sources or from our offline interactions with you to, among other things, enable us to verify, update information contained in our records, and to better customize the Service for you.

HOW WE USE DATA

We use your information for the following purposes:

To Provide our Service:

Our App is designed to help people manage and share their asset information within owners, co-owners, or other individuals you may consider appropriate. You are solely responsible for which contacts you share your asset information with. 

We process your information to provide, support, and secure our services (both automatically and manually). We may use your information in some of the following ways:

  • To help your co-owners or contacts manage their relationship with you in the App. For example, we may display your full name or email address to your asset group members, so they may identify that they are sharing asset information with the correct person.
  • To help registered Service Providers contact you directly about Service Requests you sent in the App, and contact you directly about quotes, dates of service, and issues related to the service you requested.
  • We use the information that we collect on the Service to operate, maintain, enhance and provide all features of the Service, to provide services and information that you request, to respond to comments and questions and otherwise to provide support to users.
  • We use the information that we collect on the Service to analyze Site usage, perform market research, project planning, product development, troubleshooting problems, analysis of user behavior, internal marketing and promotions, or other efforts to improve our service quality.
  • We use the information that we collect on the Service to understand and analyze the Service usage and preferences of our users, to improve the Service, to generate statistics and Reputation Scores, to make recommendations, and to develop new products, services, features, and functionality.
  • We may use your email address or other information we collect to contact you for administrative purposes such as customer service or to send communications, including updates relating to products or services we offer.
  • We may use cookies and automatically collected information to: (i) personalize our Service, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Service; (ii) provide customized content and information; (iii) monitor and analyze the effectiveness of the Service and marketing activities; and (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed.
  • To enforce our Terms of Service.

To Allow Other Users to Find You:

Owners and co-owners can invite you to join our Service via your email address or mobile phone number. When owners or co-owners invite you to join our Service, and specifically to join an asset group, you´re only able to see that asset group you’ve been invited to join.  This also applies to Service Providers that join the service marketplace.  A registered owner/co-owner or a Service Provider may invite another Service Provider to join our Services and provide service to owners and co-owners as well.

Legal Bases for Processing Your Personal Data.

We use your data to provide, develop and maintain the App. We also use your data to operate our business and secure our rights (including defending our rights). We use your data to provide our services via the App, but we also use your data to resolve disputes, investigate security incidents, and comply with legal obligations.

With Third Party Services
We may receive and collect information about you from third parties and affiliates that help us provide, support, and secure our Services. In general, data shared with us in this manner will be treated under the same privacy restrictions as any other data shared with Appgrade Inc.. For example:

  • If you use one of the third-party payment integrations we offer, we may collect information from the service. We will use the data you’ve supplied in your account to assist in completing that payment. We may use information from that Service to display the status of that payment to you. We may also use information about payments sent via third party services to address fraud, security, or support issues.
  • We also contract with other third-party companies to provide additional services, including:
  1. User Support: User support communications, including any information provided by the user.
  2. Server Administration, App Storage, and Database Storage/Management: Server maintenance and management, including troubleshooting and log review where necessary.

To Provide Personalized Advertisements and Promotions
Where permitted by Applicable Law, we may use your email, mobile phone number, location, usage and asset information to show you specific advertisements or offers on our own Website and App, that we believe may be of interest to you. For instance, we may show ads for specific assets cheaper or better than current asset based on the asset value or expenses you share on our system.

HOW WE SHARE YOUR INFORMATION

We will not, sell, publish, or share your personal information to third parties for their marketing purposes.

To Provide Our Service

Our Service is designed to help you manage your assets among owners/co-owners through the web and mobile application.  We share some of your personal information (name, email address, phone number, user avatar) with your chosen contacts on our App. Someone who knows your email address and/or phone number will be able to invite you to join our Service and add you as an asset group member, and they will see your name, email address, and user avatar. They will not be able to see an asset information that you’ve added with other asset group owners unless you include them in an asset group.

  • Our App allows you to keep track of asset in asset groups. These groups are private, and information about that particular asset posted in a group, is only visible to other members of that asset group. However, any user in that asset group may add additional members to that asset group, so it is the joint and sole responsibility of asset group members to safeguard who they invite into their group sharing platform.
  • Our App lets asset group members add, edit, delete and undelete content shared privately.

With Third Parties, Affiliates, Subsidiaries, and Service Providers:

We employ third party agents, subsidiaries, affiliates, and/or service providers to enable them to help support and improve our Services. For example, maintenance services, database management, cloud hosting, web and mobile analytics, receipt scanning services and payment providers. Third parties acting on our behalf that are given access to your personal information are contractually obligated to abide by our privacy practices and are not allowed to use the information for any other purposes. We may share your personal information with other third parties with your consent or instructions to do so.

  • Where permitted by law, third parties may use data provided to them to improve their own services.

For Legal Matters

We reserve the right, in our sole discretion, to share or disclose your personal information with law enforcement, government officials, and other third parties:

  • To respond to subpoenas, court orders, or legal process;
  • In order to investigate, prevent, defend against, or take other action regarding violations of our Term of Service, illegal activities, suspected fraud, or situations involving potential threats to the legal rights or physical safety of any person, or the security of our network, Sites, Apps or Services;
  • To respond to claims that any posting or other content violates the rights of third parties;
  • In an emergency, to protect the health and safety of our Sites' users or the general public; or
  • As otherwise required by any applicable law.

Business Transfer
If our company, our assets or our Services are acquired by another company, or in the event of a merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation, we may transfer, sell, or assign to third parties, information concerning your relationship with us, including, without limitation, personal information that you provide and other information concerning your relationship with us. Such third parties will assume responsibility for the personal information collected by us in connection with our business operations or through our Sites/Apps and such third parties will assume the rights and obligations regarding such information as described in this Privacy Policy and according to applicable regulations.

Non-identifiable Information
We may disclose information that does not personally identify you in any other manner that we deem appropriate, including to third parties for their research, marketing, and promotional purposes and to help us determine how we can improve our Services. We will also disclose non-personal information to our service providers and other third parties about how our users collectively use our Service.

DISCLOSING INFORMATION

Except as described in this Policy, we will not disclose your Personal Information that we collect on the Service to third parties.

We may disclose information to third parties in the following circumstances:

  • Any information that you voluntarily choose to expose to other users of the Service will be available to anyone who has access to that content. For example, when an asset owner sends a Service Request to a Service Provider, that Service Provider will be able to view information about the asset owner and the asset.
  • In connection with any disclosure of Personal Information that is permitted under this Policy, we may also disclose your Reputation Scores as a Service Provider. Thus, any person who can see other information about you on the Service, such as your name or a profile image, may also be able to see your Reputation Scores as a Service Provider.
  • We work with third party service providers to provide website, application development, hosting, maintenance, and other services for us. These third parties may have access to or process your information as part of providing those services for us. Generally, we limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such information.
  • We may disclose your information if required to do so by law, or in the good-faith belief that such action is necessary to comply with applicable laws, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement, regulators, or other governmental agencies.
  • We also reserve the right to disclose your information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Service and any facilities or equipment used to make the Service available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.
  • We may disclose your Personal Information to third parties if you give your consent to such disclosure.
  • Information about our users, including Personal Information, may be disclosed and transferred to an acquirer, successor, or assignee of our Services/App as part of any merger, acquisition, debt financing, sale of stock or assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
  • We may make certain aggregated, automatically-collected, or otherwise non-Personal Information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Service.

SECURITY

How We Protect the Information We Collect
We share your data if necessary for safety, security or legal compliance, and we also understand the importance of keeping your information safe and secure.

We use technical and administrative security measures such as but not limited to encryption techniques and authentication procedures, among others, to maintain the security of your online session. Please understand, however, that while we try our best to safeguard your personal information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.

You can help protect the privacy of your own information by using encryption and other techniques to prevent unauthorized interception of your personal information. You are responsible for the security of your information when using unencrypted, public or otherwise unsecured networks.

We will contact you regarding any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal information to you via email or conspicuous posting on our Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Phishing:
Identity theft and the practice currently known as "phishing" are of great concern to us. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. COOKIES

How We May Use Cookies and Similar Technologies:
Like many websites, we use tracking technologies such as cookies, web beacons and similar technologies to record your preferences, track the use of our Service and exposure to our online advertisements. We may also use these technologies to monitor traffic, improve our Services, and make it easier to use and more relevant.

We may partner with third party advertising companies who also use these tracking tools to provide advertisements on our Website/App or other websites. These third parties may use these technologies to collect information about you when you use our services. They may collect information about your online activities over time and across different websites and other online services. They may also use persistent identifiers to track your Internet usage across other websites in their networks beyond the Websites. They may use this information to provide you with interest-based advertising or other targeted content. While we do not knowingly provide these entities with information that personally identifies you such third parties may, with sufficient data from other sources, be able to personally identify you, unknown to us.

Some content or applications on our Sites, including advertisements, are served by unaffiliated third parties. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement, you should contact the responsible advertiser directly.

Your browser or device may include “Do Not Track” functionality. Our Service’s information collection and disclosure practices, and the choices that we provide to customers, will continue to operate as described in this Privacy Policy, whether or not a Do Not Track signal is received.

Online Tracking and Interest-Based Advertising
You also have choices to limit some tracking mechanisms that collect information when you use our Services. Many web browsers automatically accept cookies, but you can usually modify your browser’s setting to decline cookies if you prefer. If you choose to decline cookies, certain features of our Services, including the Service itself may not function properly or remain accessible to you. For example, you cannot log into our Service by rejecting or removing their associated cookies. Note that if you choose to remove cookies, you may remove opt-out cookies that affect your advertising preferences.

Many of the third parties advertisers that place tracking tools on our Services are members of programs that offer you additional choices regarding the collection and use of your information.   Similarly, you can learn about your options to opt-out of mobile app tracking by certain advertising networks through your device settings.

Please note that opting-out of advertising networks services does not mean that you will not receive advertising while using our Services or on other websites, nor will it prevent the receipt of interest-based advertising from third parties that do not participate in these programs. It will, however, exclude you from interest-based advertising conducted through participating networks, as provided by their policies and choice mechanisms.

CHOICE AND ACCESS; DELETING YOUR ACCOUNT; DATA RETENTION

Choice and Access to Your Personal Information:
You may access, review, and update the personal information you have submitted to us at any time. You can make changes to your personal information from your Account Settings Page. If you need help updating or correcting your information, please contact us at support.rebien@appgradeinc.com .

Your Choices Regarding the Data we Collect and Process
In many instances, you have choices about the information you provide and limiting how we use your information. These choices, and any related consequences, are described in detail below:

  • Personal information: You may choose not to provide your personal information, such as your name, address, phone number or payment information, but then you might not be able to take advantage of many of our Sites’ features.
  • Emails, Newsletters, and other Communications: We may send periodic Service related alerts, monthly summaries, notifications, newsletters, promotions, or other information via email or push notifications. You may choose whether or not you’d like to receive alerts, summaries, newsletters and promotions by indicating your preference in your account profile or settings. You may also follow the unsubscribe instructions in the email you receive. Please note that certain Services-related messages (such as password resets) that we send are necessary for the proper functioning and use of our Services and you may not have the ability to opt-out of those messages.
  • Location Tracking: Most mobile devices allow you to control or disable the use of location services by any application on your mobile device through the device’s settings’ menu.
  • Allow Owners/Co-owners To Find and Invite You: Persons with your contact information will be able to send you App registration invitations, Service Requests, and share asset information with you in an asset group.

Deleting your account:
You may choose to close your account at any time. You can close your account from your Account Settings page, or request that we close it for you by writing to us at support.rebien@appgradeinc.com . When you close your account in this way, we may allow you to reactivate it by writing to us at support.rebien@appgradeinc.com .

Data Retention
In accordance with and as permitted by applicable law and regulations, we will retain your information as long as necessary to serve you, to maintain your account for as long as your account is active, or as otherwise needed to operate our business. We may also retain personal information to comply with law, prevent fraud, resolve disputes, enforce our Terms of Service, and as permitted by applicable law.

If you would like to fully delete your account and the information in it, you can write to us at support.rebien@appgradeinc.com . We will use commercially reasonable efforts to remove your personal information from our services so long as we do not have any legal reason or obligation to retain the record. It may take up to 90 days for your information to be cleared from our servers.

When you change or delete personal information, or close your account from Account Settings page, asset information involving you (either that you have shared or that have been shared with you) and your name may remain visible to people with whom they have been shared as part of their asset records (just as deleting an email account does not unsend emails that have already been sent).

YOUR DATA RIGHTS - EUROPEAN UNION AND SWISS USERS

You have certain rights with respect to your personal information. These rights include the:

  • Right to access your personal data
  • Right to correct or update your personal data
  • Right to restrict processing of your personal data
  • Right to portability
  • Right to withdraw consent if you have previously given it
  • Right to file a complaint with a data protection authority.

European Union and Swiss individuals with inquiries, requests or complaints, regarding your rights in regards to this Privacy Policy should FIRST contact us at support.rebien@appgradeinc.com. Please note that we may need to ask you for more information to validate your identity and process a communication request from you (e.g., service request).

If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information, including personal data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and the use and disclosure of information about you, including personal data, as described in this Privacy Policy.

CHANGES

Changes to this Privacy Policy
We may update this Privacy Policy periodically. Changes are effective immediately upon posting. The date last revised appears at the top of this Statement.
